Bombay High Court has cleared the Maharashtra government’s ₹229-crore Gateway Jetty project near the iconic Gateway of India. The verdict dismissed three legal petitions that challenged the development on environmental and heritage grounds, enabling the state to move ahead with the Maharashtra Maritime Board-led marine terminal plan. The proposed passenger jetty, spread across nearly 15 acres of ecologically sensitive coastline within Coastal Regulation Zone (CRZ) categories I and IV, had sparked concern from civic groups and residents. The petitioners argued that the marine ecology, visual aesthetics of the heritage precinct, and the lack of a sewage treatment mechanism were critical issues that warranted halting the project.
They also pointed to an earlier expert study that had recommended an alternative location at Ferry Wharf, which they claim was not given due consideration. Despite the opposition, the court upheld the government’s position, asserting that all necessary CRZ and heritage permissions had been secured lawfully. The justices noted that matters concerning project location fall within the policy domain, not judicial oversight, as long as due process has been followed. To ensure the development does not drift into commercial territory, the High Court imposed several conditions. It restricted the amphitheatre to passenger waiting only, barring it from being used as an entertainment venue. Similarly, the café will be allowed to serve only bottled water and packed food, avoiding the setup of full-service dining. Furthermore, the decommissioning of older jetties near the Gateway of India is to be conducted in phases, coordinated with naval directives.
Although the project lacks a sewage treatment facility, the court has mandated that the Maharashtra Maritime Board operate in an environmentally responsible manner. Experts note that such conditional approvals set a precedent for future urban marine infrastructure to align with sustainable design and limited commercialisation. The government has projected this project as essential to relieving the pressure on the existing Gateway jetties, which handle over 3.5 million passengers annually for routes to Alibaug, Mandwa, and beyond. The new terminal is expected to streamline ferry services while integrating with Mumbai’s broader mobility network, which includes upcoming multimodal transport hubs.
While environmental advocates remain wary of the project’s impact on the fragile marine ecosystem, infrastructure experts and government officials view the verdict as a green light to upgrade coastal infrastructure without compromising heritage or sustainability goals. The development signals a shift toward tightly regulated, carbon-conscious urban projects in coastal cities, ensuring ecological oversight is built into large-scale marine infrastructure from the outset.
